Under the requirements of the Criminal Records Review Act (1995), a record check is mandatory for anyone who works with children. In the Act, "works with children" means:
Working with children directly or having or potentially having unsupervised access to children in the ordinary course of employment or in the practice of an occupation.
The recruitment policy of the Surrey School District requires all applicants for employment to provide criminal record information upon request. Applicants are required to indicate on the application form whether they have a criminal record, or outstanding conviction. This precondition arises primarily from a concern about sexual or other abuse of children, and is intended to shelter users of schools as much as possible from persons having a history of undesirable and criminal behavior.
A form entitled "Consent for Criminal Record Search" will be supplied to applicants. Employment is subject to the criminal record search. Applicants will be expected to submit the form to the police department in the municipality where they reside, and to return the form, after completion by the police, to the Personnel Officer from whom it was obtained.
It should be noted that the police have a charge for these services, which must be paid by the applicant when he/she signs the form in the presence of the police officer. To protect the confidentiality of the information afterwards, when the completed form is returned by the police.
It should be noted that a record of a criminal offense, or of an outstanding charge, or conviction for a criminal offense, which is not properly disclosed on the application form may become the cause of immediate termination of employment form the Surrey School District. The circumstances of an offense or record may be discussed in complete confidence with the Human Resources department, who will provide every opportunity for an explanation and who will offer an appraisal of the matter in relation to employment.
Applicants may be assured any discussion or material about criminal records will be handled in complete confidence and will remain inaccessible to others.
